
The Government deems it necessary to prevent misinterpretation of several articles on The Head of the Indonesian Capital Coordinating Board Decision Number 57/SK/2004 (“SK-57”). The clarification is conducted by issuing Decision Number 70/SK/2004 on The Amendment of Decision Number 57/SK/2004 (“Decision”). The Decision consisted of 3 (three) Articles of Amendments, which amends Articles 11(4) and (6), 13(3), and 24 of SK-57 and affects the provisions of Attachments 13 and 14 of BKPM 57/2004.
Article I amends Article 11(4) of SK-57 with the addition that Head of BKPM will issue the Decision Letter relating to business licenses in the name of the relevant Minister. Previously before amendment, Article 11(4) only reads that business licenses is issued and signed by the Head of BKPM with copies to relevant officials.
Article I also amends Article 11(6). It previously reads “business license for PMA companies is effective for 30 years and PMDN as long as the company is in production”. After the amendment, the provision is clarified into “business license for PMA companies is effective for 30 years and for PMDN companies it is effective so long as the company is in production”.
The amendments to Article 13(3) are minor and involve the erasure of the dots following the stated terms and replaced with a semicolon.
Article 24 concerning importation of primary or secondary materials, previously contained only 6 (six) paragraph, has now been amended by the addition of an additional paragraph, paragraph 7, which reads: “in the framework of issuing an agreement letter with respect to the provision of import facilities the BKPM will check the installed capacity of the relevant machines slated for use with the commodity goods sort to be imported”.
Article II of the Decision amends attachments 13 and 14 of SK-57. Both of the amended forms are attached to this Decision. Attachment 13 deals with capital goods and Attachment 14 deals with commodity goods. (mma)
